How Wage Garnishment Works Under Romanian Law

Wage garnishment is the legal procedure through which part of an employee’s net salary is withheld each month to repay an outstanding debt. The measure is enforced through compulsory execution and implemented by the employer after receiving an official garnishment order from a bailiff.

In Romania, the rules governing wage garnishment are established by the Civil Procedure Code and include clear limits designed to protect the income of individuals subject to enforcement proceedings.

For employees, wage garnishment means receiving a reduced monthly income until the debt has been fully repaid. For employers, it involves the responsibility of accurately calculating and withholding the amounts required by law.

Although the procedure may seem straightforward at first glance, in practice it can involve situations requiring additional attention, particularly when multiple garnishments exist or when an employee’s income varies from month to month.

Managing these situations requires effective organization and accurate tracking of all payroll changes. For this reason, many companies choose to automate their payroll and HR administration processes, ensuring that every calculation complies with legal requirements and is completed on time.

Understanding how wage garnishment works is important for both employers and employees, as it helps prevent errors and ensures compliance with legal obligations.

What Is Wage Garnishment and How Does It Work?

Wage garnishment is one of the most common forms of compulsory enforcement. Through this procedure, a creditor recovers an outstanding debt directly from the debtor’s monthly salary.

The process involves four parties:

  • the creditor requesting repayment of the outstanding debt;
  • the bailiff responsible for enforcing the measure;
  • the employer, who withholds the applicable amount;
  • the employee whose salary is subject to garnishment.

The procedure begins when the bailiff sends an official garnishment order to the employer. From that moment, the employer is legally required to withhold the amount calculated under the applicable legal provisions each month and transfer it to the bailiff.

The obligation to withhold arises as soon as the employer receives the garnishment order. Failure to comply may result in legal liability for the garnishee, under the conditions established by law.

It is important to note that wage garnishment applies to the employee’s net salary. Social contributions and taxes are calculated first, after which the amount available for compulsory enforcement is determined.

For companies, the correct application of wage garnishments is an integral part of the payroll process.

A well-organized payroll system reduces the risk of errors and helps employers comply with all legal obligations. As a result, more and more organizations rely on payroll software that automates calculations and efficiently manages exceptional situations.

How Much Can Be Withheld from an Employee’s Salary?

Romanian legislation establishes clear limits on the amounts that may be withheld from an employee’s income.

For ordinary debts, such as bank loans or other financial obligations, up to one-third of the employee’s net salary may be withheld.

For maintenance obligations, such as child support, the withholding may reach up to one-half of the employee’s net salary.

When multiple garnishments apply simultaneously to the same salary, the total amount withheld cannot exceed half of the employee’s monthly net income. The priority of creditors and the allocation of the withheld amounts are not determined by the employer but by the legal ranking of claims and the instructions issued by the bailiff.

The law also provides additional protection for individuals with lower incomes. If the employee’s monthly income is below the national net minimum wage, enforcement may only apply to the portion exceeding half of that amount.

In practice, these limits ensure that individuals retain sufficient income to cover their basic living expenses. Even during compulsory enforcement, employees continue to receive a significant portion of their earnings.

What Are the Employer’s Obligations?

Once the employer receives the garnishment order, they must verify the employee’s information and include the withholding in the payroll calculation process.

The employer’s main responsibilities include:

  • correctly identifying the employee;
  • verifying whether other active garnishments exist;
  • accurately calculating the withheld amount;
  • transferring the withheld sums to the bailiff;
  • maintaining records of all related transactions.

In organizations with a large workforce, these tasks can become increasingly complex. Employee circumstances change continuously, including sick leave, salary adjustments, bonuses, incentive payments, or employment termination.

For this reason, effective HR administration directly supports the proper management of wage garnishments. When employee information is centralized and kept up to date, payroll calculations become more accurate and efficient.

Employers must also comply with the deadlines specified in the documents received from the bailiff and maintain complete records of every withholding made.

Situations That Require Special Attention

Applying a wage garnishment becomes more complex when several enforcement proceedings affect the same employee. In such cases, the withheld amounts must be distributed according to the legal rules without exceeding the maximum limits permitted by law.

Variable income also requires careful consideration. Bonuses, incentive payments, allowances, and other salary components may affect the employee’s net income and, consequently, the amount that must be withheld.

Another common situation arises when the employment relationship ends. In such cases, the employer must comply with the legal obligations and the enforcement documents received so that the enforcement process may continue with the employee’s new employer, if known. Fulfilling these obligations helps ensure continuity of the enforcement procedure and prevents administrative inconsistencies.

For employers, these situations require time, attention to detail, and a thorough understanding of the applicable legislation. This is one reason why outsourcing payroll-related processes can be an effective solution for reducing administrative risks.

Why Is a Well-Organized Payroll Process Important?

Wage garnishment is only one of many situations that must be managed accurately within the payroll process. A calculation error may lead to delays, discrepancies, and administrative difficulties for both the employee and the employer.

A well-organized payroll process means up-to-date data, standardized procedures, and full compliance with all legal requirements. At the same time, it provides transparency and reliability for everyone involved.

In modern organizations, technology plays a crucial role. Digital solutions reduce manual work and enable the efficient management of complex payroll situations.
